LEGAL NOTICE(S): This item is Owned, in the Possession of and being Sold by Allan Hancock College (herein: Seller). RTAuctions (herein: Service Provider), is NOT the Owner or Seller of these goods, but merely acting as Sellers Hired Service Provider, working with the Seller to facilitate the sale of It’s Surplus Items.

CANCELLATION POLICY If Buyer does not complete transaction, does not Pay for Purchase of Winning Bid and/or does not Pick Up Item for any reason, there will be a Ten Percent (10%) Cancellation Fee / Re-Listing Fee charged to Buyer.

PICK UP – LOCAL PICK UP ONLY is by appointment only to be determined by Seller. Contact Seller’s Service Provider to confirm your pick up. No shipping is available. The item cannot be prepared for pickup. Item must be removed AS-IS, WHERE-IS. Buyer must pickup at location on scheduled pickup day and time indicated and must be prepared to remove the item at their cost and with their own resources. Buyer will be responsible for all equipment, tools, personnel and transportation necessary for loading and removal from site.

Auction Close Policy: Winning Bidders will receive a complete invoice within 24 hours after close of auction. Winning Bidders must contact Seller within 2 days following notification of winning bid to make final payment arrangements. Pickup arrangements will be made at this time.

Payment Policy: Payment to be made by CASH at time of Pick Up or through Buyers PayPal account using a confirmed email address. If using PayPal full payment to be received within 2 days of auction close, or Service Provider reserves the right to cancel the transaction and sell the item to another interested party. A Non-Paying Bidder alert will be filed and Buyer will be Blocked from further Bidding activity. Payment at Pick Up will also be acceptable but, MUST be PAID, Before Item Will Be Released to Buyer. Contact Seller for acceptable terms and information.

Sales Tax Policy:  The appropriate sales tax will be Invoiced if required. Provision of a valid resale certificate or tax-exempt certification with payment may exempt buyers from sales tax.

NOTE: and the State of CA will automatically charge and collect Sales Tax as applicable, Seller has NO control or input to this procedure.

Release Of Liability: Winning bidders are required to sign a liability release form releasing the existing Owner and Seller  Allan Hancock College (Herein:“Seller”), RTAuctions (Herein:“Service Provider”), their respective Agents, Representatives, Affiliates, Officers, Directors, Employees, Auctioneers and Contractors from any future liability of these goods and services, as a condition of the close of the auction.

ALL GOODS AND SERVICES ARE PROVIDED "AS IS, WHERE IS".  THE SELLER , SERVICE PROVIDER AND THEIR RESPECTIVE AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES AND CONTRACTORS, AGENTS, REPRESENTATIVES, SPECIFICALLY DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING BUT NOT LIMITED TO, WARRANTIES OF TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. THESE ARE USED GOODS. NO COMPLETE, THROUGH INSPECTION HAS UNDERTAKEN. YOU THE BUYER BEAR THE ENTIRE RISK AS TO THE QUALITY AND PERFORMANCE OF THE GOODS, AND YOU ASSUME THE COST OF ANY NECESSARY SERVICING OR REPAIR SHOULD THE GOODS PROVE DEFECTIVE AFTER PURCHASE.

IN NO EVENT WILL SERVICE PROVIDER, THE SELLER, AND THEIR RESPECTIVE AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES AND CONTRACTORS, AGENTS, REPRESENTATIVES, BE LIABLE FOR ANY SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES (INCLUDING LOST PROFITS) ARISING OUT OF OR IN CONNECTION WITH ANY OF THE GOODS OR SERVICES PROVIDED (HOWEVER ARISING, INCLUDING NEGLIGENCE). THE ENTIRE LIABILITY OF SERVICE PROVIDER, THE SELLER, AND THEIR RESPECTIVE AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AGENTS, REPRESENTATIVES TO YOU OR ANY THIRD PARTIES UNDER ANY CIRCUMSTANCE IS LIMITED TO THE SALES PRICE OF THE RELEVANT GOODS PURCHASED AND PAID FOR. Any dispute regarding these services or the offer, auction or sale of the goods will be governed by California law and will be subject to the exclusive jurisdiction of the state and federal courts located in Ventura, California, regardless of whether the dispute is brought under contract, tort or other principles.
